Your home may still be your castle but building your castle or carrying on business from it requires compliance with the Resource Management Act 1991.
Whether you are carrying out a subdivision, constructing buildings or carrying on particular activities you will need to comply with the requirements of the Act and of the Operative District Plan. You may require consents and your neighbours and those within the general area may have rights of opposition. In many cases you will require specialist legal advice if you wish to achieve your desired outcome.
Resource Management is a specialist area with a now well established body of case law setting out the principles that underpin the administration of the Act. Often outcomes are determined by following carefully worked through strategies. For example, if your application is able to be dealt with on a non-notified basis, no rights of opposition arise.
